1. This page contains the Terms and Conditions governing your use of the eResourceHeaven.com website. These Terms and Conditions are binding on all users. Users should visit this page periodically to review its contents for updates and changes. For purposes of this Agreement, the terms "We" and "us" refer to eResourceHeaven.com. The Term "you" refers to Users of the eResourceHeaven.com web site.
   
   
2. By accepting the Terms and Conditions as outlined herein, User confirms they are of legal age in their country of residence to enter into a legal and binding contract. User further indicates to eResourceHeaven.com that you have read and understand these Terms and Conditions and will comply with them when using this eResourceHeaven.com web site and services covered and described herein.
   
   
3. Any user who does not accept or and agree to abide by all of the Terms and Conditions as listed herein, does not have a legal right to use of this web site or eResourceHeaven.com services.
   
   
4. Users may NOT open multiple accounts.
   
   
5. Payment Processing.
   eResourceHeaven.com uses PayPal to collect the membership fees applicable to the relevant membership level signed up to.
   eResourceHeaven.com also uses PayPal to collect payment from any items purchased from the site.
   At no time, will eResourceHeaven.com hold any financial details such as Credit Card number from any purchase made from eResourceHeaven.com . All such transactions shall be held by PayPal and be subject to their terms.
   eResourceHeaven.com however, will hold details of the User Paypal Email address.
   
   
6. Appropriate and Permitted Use of the eResourceHeaven.com Website.
   Users may not, under any circumstances, use this eResourceHeaven.com website to contribute, post or transmit any material of an infringing, threatening, abusive, hateful, harassing, libelous, inflammatory, obscene, indecent, pornographic, profane nature that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability or otherwise violate any law.
   
   
7. Using eResourceHeaven.com Services.
   As we have more options, the fees will be clearly stated and you will be informed in updates of this Agreement.
   
   
8. Setting up Your eResourceHeaven.com Account.
   You can sign-up for eResourceHeaven.com by registering yourself for an account from our Register page. All you need is an email address and a PayPal account (If you do not have a PayPal account you can get one by clicking here.) to open an account.
   Note :- Email addresses with any form of auto response are not acceptable.
   Just click on the "Register" option from the menu and you will be required to fill in your information at the "Registration Form". After you fill out the registration form, you will then need to select the payment option for the membership level that you require before you can gain access to the site.
   Should a problem occur with payment, you will not be given access to the site and you will need to contact us using the Contact form and send your sign up id and details of what happened and we will get back to you ASAP.
   
   
9. Members can advertise the site and earn Affiliate Sales Commissions by promoting our web site. Once you create an account with us and thus become a eResourceHeaven.com member, you can start promoting eResourceHeaven.com and earn 50% Affiliate Sales Commissions on ALL memberships you generate and ALL additional sales made to members referred by you.
   Details of your referral information can be found on your stats page.
   There are however a few guidelines to promoting eResourceHeaven.com.
   Under no circumstances must any page of eResourceHeaven.com with the exception of the special splash page be placed on any surfing or paid to click sites. Doing such will cause your account to be immediately terminated with no refund.
   eResourceHeaven.com must also not be promoted by use of spam. Any spam complaints about any of our members will cause the appropriate account to be terminated immediately without refund. We take Spam very seriously and you should take care to familiarize yourself with our Spam policy.
   
   
10. Taxes.
    eResourceHeaven.com does not charge any taxes. User understands and agrees that you are responsible to report and pay any and all tax requirements in your national, state, or local jurisdiction. eResourceHeaven.com will not tolerate any form of tax evasion or other unlawful activity related to User's tax liabilities. We highly recommend that Users discuss any tax-related questions with a tax professional in User's jurisdiction.
    
    
11. Indemnification and Hold Harmless.
    User agrees to indemnify and hold harmless eResourceHeaven.com, its officers, directors, employees, agents, affiliates and representatives from and against any claim, cause of action or demand, including but not limited to reasonable legal, accounting and other professional fees that may result from your use of our website services or your breach of these Terms and Conditions. eResourceHeaven.com will notify users of any such claim, suit or proceeding in a timely manner. User acknowledges and agrees that should any dispute with a third party result from or arise in connection with any use of this web site or eResourceHeaven.com services, User will indemnify and hold harmless eResourceHeaven.com its employee, representatives, agents or others acting on its behalf, from any liability resulting from any legal action, claim or dispute arising in connection with User's use of eResourceHeaven.com services under these Terms and Conditions.
    
    
12. Corporate Liability Limitations.
    User understands and acknowledges that eResourceHeaven.com has no control over the quality, safety or legality of the content or information submitted by users on this eResourceHeaven.com web site. Because it is not feasible to authenticate users on the Internet; eResourceHeaven.com cannot and does not verify or confirm that each user is, in fact, who he or she purports to be.     Except as explicitly provided in the Terms and Conditions of this Agreement, eResourceHeaven.com makes no representations or warranties of any kind, express or implied, concerning our website and/or its materials, all of which are provided on an "as is" and "as available" basis. eResourceHeaven.com expressly disclaims all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement, as well as those arising by statute or otherwise in law or from a course of dealing or usage of trade. No advice or information, either verbal or written, that user may obtain through eResourceHeaven.com or our services shall create any warranty that is not expressly stated in these Terms and Conditions.
    
    
16. Breach, Revocation and Right of Refusal.
    Failure to abide by any of the Terms and Conditions of this Agreement may be considered as a material breach of contract. In such case, we reserve the right to immediately terminate or deny User the right to use our services. eResourceHeaven.com reserves the right to cancel, deny or refuse service at our sole option and discretion in the event that you have supplied us with information that we find to be false, misleading or that conceals or omits any details that could influence the services we provide to you. User understands and agrees that eResourceHeaven.com shall not be held liable for any losses or damages that may result from our refusal to provide you our services. eResourceHeaven.com may act, at its sole discretion, with respect to user-submitted information that we deem necessary or appropriate if we believe it may result in potential liability for us or that it may cause us to lose, in whole or in part, the services of eResourceHeaven.com Internet Service Provider (ISP) or other suppliers. In the event of Termination of our service, be it by eResourceHeaven.com or the User, we reserve the right to withhold any Affiliate Sales Commissions earned up to the point of termination. Also in the event of Termination, any monies paid for membership are non refundable.
    
    
17. Changes, Revisions and Modifications.
    eResourceHeaven.com reserves the right to revise these Terms and Conditions and change the services provided under this Agreement. User acknowledges that any such revision or change will be binding and will take effect immediately upon posting. User understands that, by continuing to use our services following such notice. User must abide by those revisions and changes.
    
    
18. Privacy of User Information.
    eResourceHeaven.com is committed to protecting the privacy of our users. When you send money using eResourceHeaven.com payment form, we never learn of your bank account numbers or credit card numbers. We only see your payment processor identification. When using eResourceHeaven.com services, your financial and other personal information is never passed on to third parties. All information submitted to us on our website is held in strictest confidence pursuant to our Privacy Policy. User hereby acknowledges that you have read eResourceHeaven.com Privacy Policy and that you understand and agree to those terms. By agreeing to our Privacy Policy User provides your consent for eResourceHeaven.com to use your personal and financial information and information provided about other persons involved in the company for which User seeks eResourceHeaven.com services as set out in that Privacy Policy. We do not divulge client account information unless requested by a court of law. This will only occur if the account is being operated in a suspicious manner. This way the correct information and Affiliate Sales Commissions are credited to your account. eResourceHeaven.com provides all Users with a secure environment for use of our services.
    
    
21. Email Policy.
    The User agrees that by signing up to eResourceHeaven.com they will also be signing up to receive regular emails from eResourceHeaven.com giving information about updates to the site and also emails containing promotional items and sales which we feel will be of interest to the User.
    Under no circumstances will eResourceHeaven.com give the User email addresses to any third party.
    Should the User wish to stop receiving periodic emails from eResourceHeaven.com then they will need to cancel their membership to eResourceHeaven.com.
    Furthermore, although eResourceHeaven.com will endeavor to keep email contact at a reasonable level, there may be occasions where a user may be sent more than one email within a 24 hour period.
    
    
22. Anti-Spam Policy.
    eResourceHeaven.com does not tolerate spam in any form. User understands and agrees that eResourceHeaven.com considers any spamming by User to be a breach of these Terms and Conditions, and will result in the User's account being frozen or terminated by eResourceHeaven.com. Any User who receives SPAM from a eResourceHeaven.com client should report this to eResourceHeaven.com immediately. If it is proven that any User or client engages in spam activity then eResourceHeaven.com will hold that User or client's account, notify them of the problem immediately, and enforce eResourceHeaven.com anti-spam policy. E-mail "spoofing" allows hackers to send messages to people with information that looks like it came from the official company. We will never request your password, name, address, or other such personal information by e-mail. 23. Identification Verification and Termination.
    eResourceHeaven.com reserves the right, at its sole discretion, to pursue all available legal remedies if any User is found to be in breach of these Terms and Conditions or if we are unable to verify or authenticate any information which you supply to us.
    
    
24. Severability.
    In the event that any provision of these Terms and Conditions is determined to be unenforceable, invalid, unlawful or void, by any court having competent jurisdiction, then said provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
    
    
25. License Rights.
    You must abide by the licenses provided with each product download where applicable from inside the eResourceHeaven.com member area. To clarify, each file includes a separate licence file that explains what can and can't be done with each product. These terms are in place to protect the value of your investment and we would ask you to respect them and the rights of your fellow members. While it is not our intention to dictate how you should run your business we shall seek to maintain the long term profitability for everyone selling these products by enforcing these terms. Failure to comply with these licenses by eResourceHeaven.com, its owner or partners could result in your eResourceHeaven.com membership being terminated.
    
    
26. No Income Guarantee.
    eResourceHeaven.com makes no claim regarding income guarantees or results from using its products, services, recommendations or any partner services.eResourceHeaven.com Is not responsible nor do we endorse any earnings claims that may evenutally be made by the producers of the products we make available.
    
    
27. Cancellations.
    You may cancel your eResourceHeaven.com membership at anytime you desire by deleting you account from the system and cancelling your paypal subscription. However there will be no refunds for any membership fees processed prior to your cancellation. Please note that the act of canceling your account does not constitute an automatic cancellation of your billing. Although eResourceHeaven.com will endeavor to ensure a members subscription via PayPal is cancelled as soon as a member cancellation is carried out, the responsibility falls with the User to ensure they cancel any payment subscription to us. If you cancel after a payment has been processed, there will be no refunds for that payment. You are liable for all membership fees until such times as you cancel your membership AND you payment subscription.
    eResourceHeaven.com reserves the right to cancel any member for reasons that it feels are detrimental to the site, its members, its partners or the future success of itself. Cancellations performed by eResourceHeaven.com are final and any restitution will be pro-rata of the membership fee paid within the past 30 days only. Termination of membership due to breach of any of our terms will cause the User to forfeit any fees paid and also all Affiliate Sales Commissions which may be due to the User. In the unforeseen event of eResourceHeaven.com ceasing to exist, any membership fees paid will be non-refundable.
    
    
28. Refunds.
    As you get immediate access to hundreds of ebooks and software products, under no circumstances will eResourceHeaven.com refund any money for any reason. You are agreeing that you are purchasing a membership to eResourceHeaven.com by your own accord without any coercion or intimidation by anyone associated with or not with eResourceHeaven.com. In addition, you agree not to attempt to charge back or dispute any charges made by eResourceHeaven.com to your credit card, PayPal account or any other payment processing listed at eResourceHeaven.com today or in the future. In the event of a billing error or duplicate billing eResourceHeaven.com will investigate the matter and issue a full refund if deemed necessary.
    
    
29. eResourceHeaven.com reserves the right to update or modify these Terms and Conditions at any time, at its discretion and/or according to new circumstances that may arise as a result of legal, market, technological or other changes. Consequently, we encourage all Users to review our Terms and Conditions from time to time to ensure your continued understanding, knowledge, acceptance, and compliance with them.
